1. Applicant has filed this application to deliver the various jewelry
articles in worth Rs.34,47,750/- to her on any conditions. Perused
application, say of I.O. and Ld. A.P.P. Heard both side. The I.O. have
submitted that, it is not possible for her to decide which seized article is
belongs to informant and other witnesses. Ld. A.P.P. has also submitted
that IO is unable to identify the gold of the applicant.
2. The F.I.R. shows that, informant has lodged F.I.R. alleging that,
the accused have misappropriated her aforesaid jewelry articles.
However, it appears from the say of IO that, the accused has
misappropriated the gold jewelry of informant and other witness also.
The IO has seized the said gold from the Muthut Finance company. IO
has not identified yet which gold jewelry belongs to which victim.
Therefore, without such identification, the gold jewelry worth
Rs.34,47,750/- cannot be returned to the applicant. Hence, the
application needs to be rejected. Accordingly, I proceed to pass
following order:
ORDER
The application is rejected.
