ORDER BELOW EXH.1
The accused is produced before Court today. Accused is
arrested on 14.11.2025 since then he is in jail for the offence
punishable under sections 313, 3(5) of BNS 2023. He is pleaded
guilty and submitted that, he will not repeated the crime again in
future. I have gone through the charge-sheet and also heard the
prosecution, as well as defence lawyer appearing for the accused. On
having gone through the provision of section 3(5) of BNS 2023, it
does not attract to this case. So, this particular offence under section
3(5) of BNS 2023 is required to be deleted. In short, the charge
cannot be framed against the accused in that regard. Offence under
section 313 of BNS 2023 is concerned charge is clearly attract.
Therefore, accused is charged for section 313 of BNS 2023. He
pleaded guilty. I verified he pleaded voluntarily. Hence, considering
the nature of offence, following punishment would be meet ends of
justice. Hence, I proceed to pass following order :
ORDER
1. Charge under section 3(5) of BNS 2023 is deleted.
2. Accused Juned Kifat Qureshi is convicted for the offence
punishable under Section 313 of the B.N.S. vide Section 264
of the BNSS 2023 and the accused is sentenced to undergo
simple imprisonment for the period already undergone and
shall also pay a fine of Rs. 100/- in default of payment of fine
he shall undergo further simple imprisonment for 07 days.
3. Accused is in Jail since 14.11.2025. He is entitled for set off, if

any, of the period already undergone under Section 468 of
BNSS.
4. The accused shall surrender bail bonds.
5. The seized property be given to it’s owner.
6. Copy of this order be given to the accused free of cost.
