ORDER BELOW EXHIBIT 01 IN C.C. NO. 896/N/2025

1. Perused the application and say of I.O. and Ld. A.P.P. By the
instant application the amount of Rs.8,862.37/- claimed by the applicant
which has been recovered during the course of investigation by Mahim
Police Station, in online complaint No.31906250094810. It is stated that
the applicant was cheated to the tune of total amount of Rs.8,862.37/- by
the accused is siphoned by the said unknown person. The Investigation
Officer has freezeed the said account in which the seized amount was
lying.
2. Ld. A.P.P. and Investigation Officer has submitted for passing
appropriate orders for return of the said amount to the applicant on terms
and condition. It is clear from record that amount of Rs.8,862.37/- is
transferred from applicant’s Bank and transferred into the Bank account
of accused. As such prima facie it appears that the total amount of
Rs.8,862.37/- was with the aforesaid bank account which was freeze and
thus applicant is legally entitled for its interim release. Hence, order.
O R D E R
1. Application is allowed.
2. Police Station, Mahim is hereby directed to release the
amount of Rs.8,862.37/- (Rupees Eight Thousand Eight Hundred Sixty
Two and Thirty Seven paise only) by de-freezing the account of accused
and transfer it to the account of applicant Mr. Arman Ali s/o Sahajad in

his Prathama UP Gramin Bank, A/c. No.90161700146115, Branch :
Chamkupur, IFSC Code : PUNB0SUPGB5 on his executing Indemnity
Bond of Rs.10,000/-(Rupees Ten Thousand only) on Rs.200/- Stamp
Paper.
3. The applicant is directed to re-deposit the said amount as
and when required by the Court.
Issue Humdast accordingly.
