1. Applicant/accused has filed this application to deliver the seized
passport to him and permission to travel Johannesburg, South Africa for
the purpose of job. Perused application and say of I.O. and Ld. A.P.P.
Heard both side. The I.O. and Ld. A.P.P. have objection.
2. According to IO and Ld. A.P.P., accused/applicant is citizen of
South Africa. He has committed the offence punishable under Sections
329, 115(2), 250, 324(2) of BNS r/w. Section 68 and 85 of Maharashtra
Prohibition Act. If the accused is permitted to travel abroad
permanently for the purpose of job, the case will not proceed further. It
would be difficult to secure his presence once he went to South Africa.
Therefore, his passport can not be returned and the permission to travel
abroad for the purpose of job can not be granted. Hence, I proceed to
pass the following order -
