ORDER BELOW APPLICATION FOR ISSUANCE OF PASSPORT
Applicant/accused namely Mr. Gulam Maqbool Kasim
Shaikh has filed this application for issuance of fresh passport to ten
years. He has contended that, he is facing the criminal trial.
2) Heard learned Advocate for accused and Ld. A.P.P. Perused
application, say filed by I.O. and Ld. A.P.P.
3) Accused is facing trial since the year 2014. This is not the
matter of permission to travel abroad. It is mere application towards
NOC for issuance of new passport. Merely granting permission to issue
the new passport will not allow him to travel abroad. Hence, there is no
need to have apprehension that he will abscond on issuance of new
passport. Considering the nature of offence and the above circumstance,
I do not find any reason to disallow such permission. Hence, I pass
following order :
ORDER
a) Application is allowed.
b) Permission granted to issue new passport of applicant/accused
Mr. Gulam Maqbool Kasim Shaikh for ten years subject to
condition that, he shall seek permission of this Court prior to
travel abroad.
