Order Below Bail Application
Perused bail application and say. Heard both side. Accused is
charged for the offence punishable U/Sec.303(2) of the BNS.
Prosecution alleged that, accused has stolen vehicle worth Rs.90,000/-
of the informant. Police has recovered said vehicle. Investigation is not
over. It is in progress. Offence is non-bailable. After going through the
say of I.O. it reveals that five offences are registered and pending
against the accused. According to IO, he is habitual offender. Therefore,
considering the nature of offence, the accused is not entitle to enlarge
on bail. Accordingly, I proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
