ORDER BELOW BAIL APPLICATION OF ACCUSED
NO.3 IBRAHIM SAYYED @ SYED ABBAS SHAIKH
1. The accused appeared before the court on service of
summons. He has made present application for bail. The accused
sought bail on the ground that, he is innocent and falsely
implicated in this crime. Investigation is completed. He has no
criminal antecedents. He is ready to abide by any conditions, if
imposed by the court.
2. Say of informant and Ld. APP was called.
3. Ld. APP opposed the application on the ground that
charge-sheet is filed and the offence is against women and
serious in nature. He prayed for rejection of application.
4. Having considered the facts of the case, nature of
allegations and the seriousness of the offence, custodial
interrogation is not required. There is no reason to keep him
behind the bars. The Charge Sheet is filed. The offences are
bailable in nature. Already co-accused is released on bail.
Liberty of a person is the constitutional right. Bail is a rule and
jail is an exception. Therefore, on the ground of parity, it is just
and proper to release the accused on bail. Hence, following order

ORDER
i) The application is allowed.
ii) The accused be released on bail on his
executing PB & SB of Rs.15,000/- or PB of Rs.
15,000/- and cash bail of Rs. 5,000/-.
