ORDER BELOW APPLICATION FOR ISSUANCE OF PASSPORT
Applicant/accused namely Mrs. Afifa Abuzar Shaikh has
filed this application for issuance of fresh passport to ten years. She has
contended that, she is facing the criminal trial.
2) Heard learned Advocate for accused and Ld. A.P.P. Perused
application, say filed by Ld. A.P.P.
3) Accused is facing trial since the year 2012. This is not the
matter of permission to travel abroad. It is mere application towards
NOC for issuance of new passport. Merely granting permission to issue
the new passport will not allow her to travel abroad. Hence, there is no
need to have apprehension that she will abscond on issuance of new
passport. Considering the nature of offence and the above circumstance,
I do not find any reason to disallow such permission. Hence, I pass
following order :
ORDER
a) Application is allowed.
b) Permission granted to issue new passport of applicant/accused
Mrs. Afifa Abuzar Shaikh for ten years subject to condition
that, she shall seek permission of this Court prior to travel
abroad.
