ORDER BELOW EXH.1 IN C.C.NO. 7836/PS/2022
Perused the record. It appears that the chargesheet is filed
u/sec. 4 (a) 5 of Bombay Gambling Act. The record further shows that
till today, police machinery miserably failed to execute NBW on all
accused. Sufficient and considerable opportunity as well as time is given
to police machinery. Case is 2 years old. Hence, in such situation, no
purpose will be served by keeping it pending. Therefore, in such facts &
circumstances, the proceeding of the case is stopped u/sec.258 of the
Code of Criminal Procedure. The accused are acquitted and their bail
bonds, if any be canceled. Seized cash of Rs.1500/- be forwarded and
credited to Government and remaining muddemal be destroyed. It be
closed.
