ORDER BELOW EXH.1
1. The present application is filed under Section 13 of Registration of
Births and Deaths Act, 1969.
2. It is the case of the applicant that she is married. Name of her husband is
Mr. Sandeep Krishnarao Divgikar, who died on 15.09.2001. His birth took
place on 03.09.1950 at Patkar’s Nursing Home, Band Stand, Bandra West,
Mumbai – 400 050. However, it was not registered at relevant time. She also
made inquiry with concerned authorities for registration, but birth certificate
not traced. Her request to register the death of late Mr. Sandeep Krishnarao
Divgikar, was also rejected. She is in need of such registration for availing
future facilities in India and abroad for herself and her son. Therefore, she
prayed to order and direct the respondent to register the birth of her husband.
3. The application is supported by her affidavit. Applicant also filed on
record various documents, including copy of S.S.C. Board Certificate, Passport,
Election ID Card, PAN Card, etc. From the contents of application and
evidence produced it is clear that late Mr. Sandeep Krishnarao Divgikar, was
born on 03.09.1950, at Bandra, Mumbai. Applicant is in need of its registration
certificate for various purposes. Nobody objected to the application and hence,
following order -
ORDER
a. Application is allowed.
b. Respondent the Ward Officer, H/West Ward, Hasanabad Lane, Khar
West, Mumbai, is herewith directed to register the birth of applicant's husband
named Mr. Sandeep Krishnarao Divgikar, as 03.09.1950, in record maintained
by him after payment of necessary fees by the applicant and issue birth
certificate accordingly.
c. Copy of this order shall be given free of cost to the applicant.
