ORDER BELOW APPLICATION AT (Exh.-20)
Ld. Advocate Shri Kolhe for applicant pressed the application
for interim reliefs.
2. Ld. Advocate Smt. Sayali Sawant for respondent submits that,
last chance be granted to file affidavit of Assets and Laibilities. To which
Ld. Advocate Shri Kolhe strongly objected and submits that, already four
to five dates have been given to respondent to file his affidavit of Assets
and Liabilities. Therefore, order of interim maintenance in favour of
applicant be passed.
3. The proceeding is under the provision of the Protection of
Woman From Domestic Violence Act. Wherein the applicant has sought
relief of interim maintenance under section 23 r/w.s. 20 of the said Act. In
order to determine the financial position of parties the Hon’ble Apex Court
in case of Rajnish V/s. Neha directed to the parties to the domestic
violence proceeding to file their respective affidavits of Assets and
Liabilities.
4. Accordingly, the applicant has filed her affidavit of Assets and
Liabilities alongwith main petition. Muchmore time has already given to
respondent to file his affidavit of Assets and Liabilities. Unless the
respondent is file affidavit of his Assets and Liabilities court cannot comes
to the correct conclusion in respect of the interim relief sought by the
applicant and the defence putforth by the respondent. In such
circumstances I am of opinion that, last chance is hereby granted to
respondent to file his affidavit of Assets and Liabilities. On the next date if

respondent is failed to file his affidavit of Assets and Liabilities then the
court will proceed according to law.
