Perused bail application and say. Heard both side. Perused written
argument filed by Ld. Advocate for accused. Accused Mr. Prabhakar
Bhausaheb Shelake is charged for the offence punishable U/Secs.319(2),
318(4), 336(2), 338, 336(3), 340(2), 61 of the BNS and Sections 66-C and
66-D of Information Technology Act. Prosecution alleged that, accused has
cheated the informant and misappropriated worth of Rs.39,43,000/-. Amount
is huge. Charge sheet is filed. Offence is non-bailable. Ld. Advocate for
accused has relied on P. Chidambaram Vs Directorate of Enforcement ((2019)
12 S.C.R. 172), Satender Kumar Antil Vs Central Bureau of Investigation and
anr. ((2022) 10 S.C.R. 351) and State of Rajasthan, Jaipur Vs Balchand @
Baliay (536 (1978) 1 S.C.R.). I have perused cited case laws. The facts in
cited case laws are distinguishable with the above facts of case in hand.
Hence, with utmost respect the cited case laws are not applicable to the case
in hand. Therefore, the accused is not entitle to enlarge on bail. Accordingly, I
proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately through the
Superintendent of Jail.
