Perused bail applications and say. Heard Ld. A.P.P. and Ld.
Advocate Shri. Amit Desai for accused. Accused Mr. Daniel Arumugam,
Mr. Deepayan Banerjee, Mr. Gigil Sebastian and Mr. Chandrashekhar
Naik are charged for the offence punishable U/Secs.318(4), 319(2),
336(2), 356(2) of the BNS and Sections 66-C and 66-D of Information
Technology Act. Prosecution alleged that, accused have published the
deepfake videos and thereby they have promoted to cheat the people
across the India to invest in share market. It is further submitted by the
IO that they have given access to the Chinese people. According to IO
this fraud may be for Rs.400 crore. The alleged fraud is worked out
against the India. Amount of fraud is huge. Offence is non-bailable.
Investigation is not completed. It is in progress. Ld. Advocate for
accused has relied on Gurucharan Singh and ors. Vs State (Delhi
Administration) ((1978) 1 SCC 118) and Rajesh Shantilal Adani and
anr. Vs State of Maharashtra and anr. (2025 SCC Online Bombay 610). I
have perused cited case laws. The facts in cited case laws are
distinguishable with the above facts of case in hand. Hence, with utmost
respect the cited case laws are not applicable to the case in hand.
Therefore, the accused are not entitle to enlarge on bail. Accordingly, I
proceed to pass the following order -

ORDER
1. Applications are rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
