Today, accused Nos. 1 to 3 appeared before me in lok-adalat
and submitted that they want to voluntarily plead guilt after pleading not
guilty earlier. They are identified by their advocate. The accused are
voluntarily pleading guilty. Trial is separated against them. Hence, the
application is allowed.
Heard accused in person. They submitted that lenient view
may be taken as they are only earning member in their respective family.
Considering the nature of offence, circumstances under which it is
committed, antecedents of the accused & their age, I proceed to pass
following order :

O R D E R
1. The accused 1. Jiyaullah Tahasildar Shaikh 2. Abdul Rajak Ansari,
3. Wasim Naeem Khan and 4. Rafiq Ajij Sande are hereby
convicted for the offence under Section 4, 5 of of Bombay
Gambling Act, 1887 and sentenced to pay fine of Rs. 300/-
( Rupees Two Hundred only) each, and in default of payment
of fine, to suffer simple imprisonment for 3 (Three) days
each.
2. Their bail bonds are forfeited. Cash bail, if any, be credited to
Government.
