ORDER BELOW EXH.1 IN C.C.NO. 8076/PS/2022
Perused the record. It appears that the chargesheet is filed
u/sec. 8 (c) r/w 27 of NDPS Act. The record further shows that till
today, police machinery miserably failed to execute summons on the
accused. Sufficient and considerable opportunity as well as time is given
to the police machinery. Case is 2 years old. Hence, in such situation, no
purpose will be served by keeping it pending. Therefore, in such facts &
circumstances, the proceeding of the case is stopped u/sec.258 of the
Code of Criminal Procedure. The accused is discharged and his bail
bonds, if any be canceled. It be closed.
