Perused bail application and say. Heard both side. Accused Mr.
Rohan Radhakrushnan Menon @ Pratik Radhakrushnan, is charged for
the offence punishable U/Sec.61(2), 319(2), 318(4), 336(2), 338,
336(3), 340(2) of the BNS and Sections 66-C and 66-D of Information
Technology Act. Prosecution alleged that, accused has cheated the
informant and misappropriated Rs.5,24,00,000/- by cyber fraud and
misappropriated the said amount. Moreover, prima facie accused has
connection with cyber fraud of Rs.65 crore of approximately 30 persons.
Huge amount involved. Charge sheet is filed. Ld. Advocate for accused
has relied on Sanjay Chandra Vs CBI (AIR 2012 SC 830). I have perused
cited case law. The facts in cited case law are distinguishable with the
facts of case in hand. Hence, with utmost respect the cited case law is
not applicable to the case in hand. Therefore, the accused is not entitle
to enlarge on bail. Accordingly, I proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
