COMMITTAL ORDER
The accused No.1 to 3 are produced before the Court
through Video Conferencing. They are in Jail. They are charged with
the offence punishable under Sections 109, 309(6), 61(2), 352, 351(2)
of B.N.S.2023 r.w. Sec.37,135 of Maharashtra Police Act. The offence
punishable under Section 109 of The Bharatiya Nyaya Sanhita, 2023 is
exclusively triable by the Hon'ble Court of Sessions. The copies of
police report and other documents as specified in section 230 of The
Bharatiya Nagarik Suraksha Sanhita,2023 have been supplied to the
accused. The case will have to be committed to the Hon'ble Court of
Sessions in view of nature of offence. Hence, the following order :-
O R D E R
1. The case is hereby committed to the Hon'ble Court of Sessions.
2. Accused is remanded to Magisterial Custody until commitment of
the case and also during and until the conclusion of trial before the
Hon'ble Court of Session vide section 232 (a) (b) of The Bharatiya
Nagarik Suraksha Sanhita,2023.

3. The Jail Authorities is directed to produce the accused before
the Hon'ble Court of Session on 06.01.2025 on receiving production
warrants from that Court in Form No. IV, Chapter XXXIII of the Criminal
Manual.
4. The record of the case, the documents and articles, which are to
be produced in evidence, shall be sent to the Hon'ble Court of Sessions.
6. The Police Station Officer, Police Station Khar is directed to
produce muddemal property, in the Hon'ble Court of Session on or
before 06.01.2025.
7. The Public Prosecutor shall be notified of the commitment of the
case to the Hon'ble Court of Sessions.
