1. Perused record. Heard Ld. A.P.P.
2. The present final report is filed in respect of offences punishable
under Section 406, 420, 506(Part II) of Indian Penal Code, stating that
there occurred delay in filing it, therefore, delay shall be condoned.
Matter be registered and process shall be issued.
3. The punishment for major offences in respect of which final report
is filed, is beyond the period of three years. Therefore, Section 468 of
Code of Criminal Procedure, have no application to the matter. There
arises no question of limitation and consequent condonation of delay.
Accordingly, following order -
ORDER
a. Matter is ordered to be re-registered as regular criminal case filed
on police report.
b. Cognizance of offences punishable under Section 406, 420,
506(Part II) of Indian Penal Code, taken. Issue process against accused,
r/o.06.04.2023.
