ORDER BELOW EXH. 1
1) Applicant praying for direction to respondent to register
the birth of his son namely Devesh Pankaj Singh. He submitted that, on
04/02/2019 his son namely Devesh Pankaj Singh born at Dattatreya
Nursing Home, Opp. Bandhutva CHS, Datta Mandir Road, Vakola
Bridge, Near Patuck School, Santacruz (E) Mumbai400055. However,
entry regarding his birth was not taken with the office of respondent.
He requires birth certificate of his son. Hence, this application is filed.
Applicant in support of his contention has filed Discharge Card issued
by Dattatreya Nursing Home and Vaccination Card, affidavit of witness.
Application is well supported by affidavit of applicant and his wife.
2] Respondent made inquiry about the claim of the applicant.
On inquiry respondent found that contention of the applicant is correct.
Respondent did not objected the application. Considering the
contention of both the parties and documents filed by the applicant it
appears that, the date of the birth of Devesh Pankaj Singh is correctly
mentioned. Admittedly, after the birth of Devesh Pankaj Singh the entry
thereto was not taken in the concerned register even after laps of more
than 04 years. Therefore, Respondent needs to be directed to take entry
regarding birth of Devesh Pankaj Singh in the concerned register.
Hence, the following order is passed.
O R D E R
1. Application is allowed.
2. On payment of requisite charges respondent is directed to
take entry regarding the date of birth of Devesh Pankaj Singh,
as on 04/02/2019 in the concerned register.
