ORDER PASSED BELOW EXH.1
This application is filed by the applicant namely Hiralal
Narayan Chandra Ghosh for release of autorickshaw bearing No.MH02
EW3451 which is seized by the Excise FSI Division in connection with
Crime No.290/2022 registered with the Excise FSI Division for the offence
punishable under sections 65(A)(E) of the Bombay Prohibition Act, 1949.
2) Both objected said application and submitted that said
muddemal is required at the time of trial. She prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record verified copy of RC book, permit, Aadhar card, expired
fitness certificate, xerox copy of insurance paper and original copy of
vehicle particulars alongwith his affidavit. Applicant failed to file fresh
fitness certificate on record. Therefore, he is not entitled to get the custody
of seized muddemal. Under such circumstances, I pass following order :
