Order Details: Order Below EX 1 Pdf Text: ORDER BELOW EXHIBIT - 01 1. Today the matter is taken before this Court in Special Drive for petty offences. 2. Perused record. The offences are triable as summons case. Accused absent. The record shows that allegations are vague and the basic requirements to prove the charge are missing. One of the basic requirement to prove the charge is report of Chemical Analyzer. The said report is also not filed with record. The whole final report even if, accepted as it is no conviction is warranted. There is no point in securing the presence of the accused in these background facts and circumstances. Proceeding further with trial is nothing but an empty formality. Considering all these factual and legal aspects, there is no point in proceeding further with the present matter. Therefore, following order : ORDER A. The proceeding stopped under Section 258 of Code of Criminal Procedure and accused discharged. B. Cash security, if any, deposited is forfeited to the Government. C. Cash, if any, seized is forfeited to the Government. Other property, if any, seized shall be disposed off as per rules. D.
