REASONS
The accused is produced before the court through video
conference today. Charge is framed against him, to which he voluntarily
pleaded guilty as per the application at EXH. 2. Accused is in jail since
21.09.2024. Heard accused in person. He submitted that, lenient view may
be taken as he is the only earning member of his family. Considering the

nature of offence, antecedents of accused, age of accused and the period of
detention already undergone, pass following order :-
ORDER
i) Accused Ahamed Shoeb Shaikh @ Ahamed Batla is convicted
under section 264 of Bhartiya Nagrik Suraksha Sanhita for the
offence punishable u/sec. 309(6) of Bhartiya Nyay Sanhita. He
is sentenced to suffer R.I. for Six (6) months and fine of
Rs.2,000/- (Two Thousand) in default of payment of fine, he
shall undergo further S.I. for Six (6) days.
ii) Accused Ahamed Shoeb Shaikh @ Ahamed Batla is convicted
under section 264 of Bhartiya Nagrik Suraksha Sanhita for the
offence punishable u/sec. 333 of Bhartiya Nyay Sanhita. He is
sentenced to suffer R.I. for Six (6) months and fine of
Rs.2,000/- (Two Thousand) in default of payment of fine, he
shall undergo further S.I. for Six (6) days.
iii) Both sentences shall run concurrently.
iv) Accused is in jail since 21.09.2024. He is entitled to get benefit
of set off for the period of detention already undergone vide
under section 468 of B.N.S.S.
v) Seized I-phone 15 Pro Max mobile phone already returned to
informant. He shall retain the same permanently.
vi) Copy of this judgment be supplied to accused free of cost
forthwith.
