COMMITTAL ORDER
Accused No. 1 to 6 are present. Accused No.1 to 5 are in
MCR since 18/09/2024. They are charged with the offence punishable
under sections 204, 318(4), 319(2) 137(2),111, 61(2),3(5) of The
Bharatiya Nyaya Sanhita, 2023. The offence punishable under section
111 of The Bharatiya Nyaya Sanhita, 2023 is exclusively triable by the
Hon'ble Court of Sessions. The copies of police report and other
documents as specified in section 230 of the Bharatiya Nagrik Suraksha
Sanhita,2023 have been supplied to the accused. The accused are
represented by Lawyer. The accused No.6 is on ad-interim anticipatory
bail. The charge-sheet came to be filed on 08/11/2024. As such since
nearly two months, because of the non-compliance of the order by
accused No.6, the case against accused No.1 to 5 could not be
committed and they are languishing in jail. As such the case will have
to be committed to the Hon'ble Court of Session. Hence, the order :-
O R D E R
1. The case be committed to the Hon'ble Court of Session.

2. The accused No.1 to 6 are directed to appear before the Hon'ble
Court of Session on 20/01/2025.
3. Accused No.1 to 5 are remanded to Magisterial Custody until
commitment of the case and also during and until the conclusion
of trial before the Hon'ble Court of Sessions vide section 232 of
the Bharatiya Nagrik Suraksha Sanhita,2023.
4. The Jail Authority is directed to produce the accused No.1 to 5
before the Hon'ble Court of Sessions, Gr. Bombay on
20/01/2025 .
5. The record of the case, the documents and articles, which are to
be produced in evidence, shall be sent to the Hon'ble Court of
Sessions.
6. The Police Station Officer, Police Station Khar be directed to
produce muddemal property in the Hon'ble Court of Session on
or before 20/01/2025.
7. The Public Prosecutor shall be notified of the commitment of the
case to the Hon'ble Court of Session.
