ORDER BELOW EXH.1
1. The accused Mr. Ruby Shantaram Gadakannu, appeared before this
court through video conferencing on 06.12.2022. The accused pleaded
guilty to the offence. His plea is voluntary as despite giving clear
understanding to him about the effect of punishment, he has pleaded
guilty to the offence. Plea accepted.
2. The accused has stolen the cash, of value of Rs.1,085/-. Heard him on
the point of sentence. He is in jail since 07.11.2022. He prayed for leniency.
Considering the nature of offence, the property involved and the period
undergone by the accused, following order:
ORDER
A. Accused Mr. Ruby Shantaram Gadakannu, is convicted under Section
241 of the Code of Criminal Procedure, for an offence punishable under Section
380 of Indian Penal Code and sentenced to suffer rigorous imprisonment for
fifteen days.
B. Accused Mr. Ruby Shantaram Kadakannu, is entitled to set off as per
Section 428 of the Code of Criminal Procedure. As he is in jail since
07.11.2022, the punishment has already been undergone by him, therefore, he
shall be released forthwith if not required in any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
