ORDER BELOW EXH.1
1. Accused produced with charge sheet/final report of investigation at
01.30 p.m. Prima facie case made out. Cognizance taken of an offence
punishable under Section 379 of Indian Penal Code.
2. Accused has no complaint of ill-treatment at the hands of police.
He is taken in M.C.R. upto 22.10.2024.
3. The accused pleaded guilty to the offence. He is totally made aware
of the consequences of the pleading guilty to the offence. Despite that he
is ready to plead guilty. His plea is voluntary.
4. Heard him on the point of sentence. He prayed for leniency on the
ground of poverty, etc. Accused stolen mobile phone, of value of
Rs.14,000/-. There is substance in the ground pleaded for leniency.
Considering the nature of offence and his prayer, following order :
ORDER
A. The accused is convicted under Section 241 of the Code of
Criminal Procedure, for an offence punishable under Section 379 of
Indian Penal Code and sentenced to suffer simple imprisonment till rising
of the court.
B. Accused is in custody and shall be released forthwith after rising of
court, if not required in any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
