ORDER BELOW EXH.1
Accused is in jail custody. He is represented by Advocate. His Advocate
present. Accused for accused filed an application/pursis of compounding the matter
on the ground that matter is amicably settled between the parties outside the Court.
In the said pursis, it is stated that informant does not want to proceed with the
matter. Original complainant/informant is present before the Court. He has
conceded for compounding the offence. He has filed his identity card on record.
Offene u/sec. 379 of IPC is of compoundable nature. The charge against the
accused is framed. The accused is in jail. Considering this position on record, case
needs to be disposed of as compounded. Hence, I pass following order :
ORDER
1) Accused Devendra Manohar Chalke is acquitted of the offence punishable
u/sec. 379 of the IPC as per section 320 (8) of the Cr. P. C.
2) The accused is in jail. He be released forthwith, if not required in any other
case. Inform the jailor accordingly.
3) Seized muddemal property i.e. Honda Active bearing no. MH02CS4985 is
in the police station. It be returned to the informant, on proper identification.
4) Pronounced in the open Court.
