ORDER BELOW EXH. 1
1) Applicant praying for direction to respondent to register
the birth of her daughter namely Hafsa Mohammed Qamar Ansari. She
submitted that, on 11.08.2019 her daughter namely Hafsa Mohammed
Qamar Ansari born at 2A/602 SRA BKC, Pathar Nagar, Bandra east,
Mumbai400051. However, entry regarding her birth was not taken
with the office of respondent. She requires birth certificate of her
daughter. Hence, this application is filed. Applicant in support of her
contention has filed discharge card and medical papers issued by KEM
hospital.
2] Respondent did not dispute that on dated 11.08.2019 the
daughter of the applicant was born and the entry thereto was not taken
in the concerned register. Considering the discharge card and medical
papers issued by KEM hospital filed by the applicant it appears that the
date of the birth of Hafsa Mohammed Qamar Ansari is correctly
mentioned. Admittedly after the birth of Hafsa Mohammed Qamar
Ansari the entry thereto was not taken in the concerned register even
after laps of more than 02 years. Therefore, Respondent needs to be
directed to take entry regarding birth of Hafsa Mohammed Qamar
Ansari in the concerned register. Hence, the following order is passed.
O R D E R
1. Application is allowed.
2. On payment of requisite charges respondent is directed to
take entry regarding the date of birth of Hafsa Mohammed
Qamar Ansari as on 11.08.2019 in the concerned register.
