ORDER BELOW EXH. 1
1] Applicant praying for direction to respondent to register the
death of his father namely Asagar Ali Shaikh. He submitted that, on
04/10/2019 his father namely Asagar Ali Shaikh died. However, entry
regarding her death was not taken with the office of respondent. He
requires death certificate of his father. Hence, this application is filed.
Applicant in support of his contention has filed Medical Certificate of
deceased Asagar Ali Shaikh issued by Municipal Corporation of Mumbai
and extract of the disposal registry entry.
2] Respondent did not disputed that on dated 04/10/2019 the
father of the applicant was expired and the entry thereto was not taken
in the concerned register. Considering the Medical Certificate of
deceased Asagar Ali Shaikh issued by Municipal Corporation of Mumbai
it appears that the date of the death of Asagar Ali Shaikh is correctly
mentioned. Admittedly after the death of Asagar Ali Shaikh the entry
thereto was not taken in the concerned register even after laps of more
than 02 years. Respondent needs to be directed to do so. Hence, the
following order is passed.
O R D E R
1] Application is allowed.
2] On payment of requisite charges respondent is directed to
take entry regarding the date of death of Asagar Ali Shaikh
as on 04/10/2019 in the concerned register.
