ORDER
1. The applicant is praying for return of Gold rings seized by
Santacruz Police Station in C. R. No.1137/2012 registered u/sec. 170, 420,
34 of IPC.
2. The Investigating Officer has given no objection to return the
seized property to the applicant. APP objected to release the rings as it
requires for trial.
3. Applicant submitted that seized gold rings belong to him.
Crime was registered on his report. In support of his contention he has
produced copy of FIR and Aadhar Card. There is no rival claim by any
person in respect of the seized ornament. No good purpose would serve
keeping the ornament with the police pending the trial of the case. For the
apprehension of APP conditions can be imposed. Applicant is entitled to
receive the seized ornament on conditions. In the result, following order is
passed:
ORDER
1. The custody of Gold rings seized by Santacruz Police Station
in C. R. No.1137/2012 registered u/sec. 170, 420, 34 of IPC
be returned to the applicant on furnishing indemnity bond
of Rs.10,000/.
2. Applicant is directed not to transfer, alter, dispose in any
manner said property to third person without prior
permission of Court and to produce it before the Court,
whenever required for trial.
3. The investigating officer is directed to take photographs of the
seized ornament and to produce the same and indemnity
bond along with the final report.
