J U D G M E N T

1. The accused is charged for the offence U/Sec.305 (a), 331 (4)
of The Bharatiya Nyaya Sanhita, 2023.
2. The accused is produced today in court through video
conferencing mode. Accused voluntarily pleaded guilty to the charge. It
appears that, the plea of the accused is voluntary. Hence, the plea is
accepted.
3. Heard the accused on the point of sentence. The accused
submitted that, his economic condition is not sound and his family is
depend on him. The accused prayed that minimum punishment may be
imposed.
4. The prosecution could not show that, the accused has criminal
antecedents. Considering nature of the offence and the circumstances it
will be just and proper to pass the following order.

O R D E R
1. Accused viz. Subhan Sajid Ansari is convicted vide Sec.
264 of The Bharatiya Nagarik Suraksha Sanhita, 2023 for
the offence punishable U/Sec. 305 (a) of The Bharatiya
Nyaya Sanhita, 2023 and is sentenced to suffer Rigorous
Imprisonment for 45 (Forty Five) Days and to Pay fine of
I100/- (One Hundred) in default of payment of fine
accused is sentenced to suffer Simple Imprisonment for 01
(One) Days.
2. Accused viz. Subhan Sajid Ansari is convicted vide Sec.
264 of The Bharatiya Nagarik Suraksha Sanhita, 2023 for
the offence punishable U/Sec. 331 (4) of The Bharatiya
Nyaya Sanhita, 2023 and is sentenced to suffer Rigorous
Imprisonment for 45 (Forty Five) Days and to Pay fine of
I100/- (One Hundred) in default of payment of fine
accused is sentenced to suffer Simple Imprisonment for 01
(One) Days.
3. Both sentences shall run concurrently.
4. The accused is entitled to get benefit of set off, as per the
provisions of Sec.468 of The Bharatiya Nagarik Suraksha
Sanhita, 2023.
5. The seized muddemal property be returned to its lawful
owner, as per rule, after appeal period is over.
6. Copy of Judgment be given to the accused free of cost.
