ORDER BELOW EXH.-1
1. This is an application for release of property.
2. As per applicant his Honda motorcycle bearing registration No.MH-
01-DG-8354, stolen from Dharavi, Mumbai and later on at his instance
offence was registered with respondent police station at C.R. No.662 of
2024 for offence punishable under Section 303(2) of Bharatiya Nyaya
Sanhita. The said valuable stolen article recovered and now he claimed by
way of this application.
3. Say of the respondent was called. The Investigating Officer and Ld.
A.P.P. have no objection to handover the article to the applicant. The record
shows that applicant is legal claimant and is entitled to it’s possession. If
remained in custody of respondent it will damage and applicant may suffer
irreparable loss. Investigation relating to vehicle is over. Thus, there
appears no hindrance in allowing the application. Therefore, following
order -
ORDER
a. The respondent is directed to handover the custody of the article
mentioned in it’s say to the applicant on executing indemnity bond of
Rs.40,000/- (Rs. Fourty Thousands Only).
b. The applicant shall furnish two photographs of the article while
taking custody and shall not permit any others to use it.
c. Copy of this order shall be kept in C.R. No.662 of 2024.
