ORDER BELOW EXH.6
1. Perused record. Heard both the sides.
2. The present application is filed after filing of charge sheet by
accused Mr. Rhidoy Yasin Hasan, under Section 437 of Code of Criminal
Procedure, for bail mainly on following grounds that investigation is
over. Accused is innocent. He is ready to remain abide by the conditions.
Offence is not much serious, etc. The Ld. A.P.P. objected to it stating that
accusations are based on cogent material. The accused is not resident of
India. There is possibility of absconding and tampering, etc.
3. The submissions of both the parties are in tune with their respective
contentions.
4. The summary of the allegations is that the accused is resident of
Bangladesh and residing in India without any authorization. In support of
these allegations the Investigating Officer filed several documents on
record supporting the allegations. Against it, it is specifically mentioned
in the application itself applicant possesses no documentary evidence in
support of his claim of Indian citizenship. The applicant however, filed on
record copy of Aadhar Card, which is not proof of Indian citizenship. The
document produced with charge sheet clearly showing the involvement of
the accused. There is every possibility of tampering and absconding.
Therefore, application lacks merit and hence, order -
ORDER
Application is rejected.
