ORDER
Read complaint, verification of complainant. Perused the
documents placed on record.
2. Heard Ld. Advocate Shri. Carl Patel for complainant.
According to the complainant accused No.2 to No. 4 are director of
accused No.1 company. Accused have availed the loan of I Fifteen Crore
from complainant and agreed to pay the monthly loan installments.
However, accused failed to pay the monthly installments. The cheque
bearing No.241, drawn on HDFC Bank, Branch-Kalina, dated
01/04/2024, issued by accused are also dishonoured. Accused since
inception have intention to cheat the complainant in this complaint.
3. The complainant’s verification statement (Exh.-2) discloses
that, the cheque given by accused dishonoured and it further discloses
that, since inception accused have intention to cheat the complainant
and the accused have did not repay the loan installments. The
prima-
facie ingredients of section 420 of Indian Penal Code have been made
out against accused by the complainant. Therefore, issue process under
section 420 r/w.s. 34 of the Indian Penal Code against accused.
Case be registered as SW case.
