ORDER BELOW EXH.1 AND REPORT OF SERVICE OF WARRANT
1. Respondent Mr. Vicky Bala Bajaj, is produced at 02.45 p.m., by
Shri. Amar Kumbhar, Police Head Constable, Bandra Police Station,
Mumbai, as recovery-cum-arrest warrant served upon him. He has no
complaint of ill-treatment.
2. Ld. Advocate Mr. Sunil Yadav, present for respondent. Ld.
Advocate Mr. Shaikh Shayan, present for applicant. It is submitted that
for the various reasons mentioned he failed to pay the amount, respondent
is ready to pay Rs.70,000/- today towards arrears of maintenance and will
clear the dues on or before next date. Therefore, he shall be discharged
from custody.
3. Ld. Advocate for the respondent submitted that the notice has not
been served upon him and respondent is directly arrested without having
knowledge of the present proceeding. The original matter is of the year
2022. No maintenance paid or received by the applicant and her children.
Respondent was aware of the order. Therefore, in this proceeding
recovery-cum-arrest warrant was issued. Therefore, it can not be said that
action is not justifiable.
4. Accordingly, following order -
ORDER
A. Respondent is discharged from custody subject to payment of
Rs.70,000/- today and condition that respondent shall deposit the
remaining amount of arrears on or before next date.
B. It is informed that Rs.70,000/- paid through online, therefore,
respondent is discharged from custody.
