Firstly, that you on 14.08.2026 at public place, within the
jurisdiction of said Excise Division found drunk or drinking in a common
drinking house or is found there present for the purpose of drinking and
thereby you have committed an offence punishable under section 84 of
Maharashtra Prohibition Act, 1949 and within my cognizance.
And I hereby direct that you be tried by me on the aforesaid
charge.

Today, the accused is appeared before me and made
application for pleading guilty at Exh-3. He has submitted that he wants
to plead guilt. He is identified by his advocate. Particulars of offence is
framed against him, to which he voluntarily pleaded guilty. Heard
accused in person. He submitted that lenient view may be taken as he is
only earning member in his family. Considering the nature of offence,
circumstances under which it is committed, antecedents of the accused &
his age, I proceed to pass following order :
O R D E R
1. The accused is hereby convicted for the offence under 84 of
Maharashtra Prohibition Act and sentenced to pay fine of Rs. 3,000/-
(Rupees Three Thousand only), and in default of payment of fine,
to suffer simple imprisonment for 3 (Three) days.
2. Seized liquor be forwarded to Excise Department and remaining
muddemal be destroyed.
