Cross-examination resumed on:-
21. My husband is working at K/West Ward, Andheri in
BMC. He is a sweeper. My husband and accused are not working in
the same ward. My husband is a graduate person. I don’t know the
educational qualification of the accused. I am aware that the accused
is working in the BMC. I don’t know that whether or not the accused
is able to read. I know the accused through my husband. I don’t know
when I met the accuse first time. The witnesses volunteers that I
know the accused from 2009. From 2009 to 2021 there was single
transaction between the accused and my husband. I paid the accused
amount of Rs.3,00,000/- in cash. It is not true to say that in August
2021 I have not paid amount of Rs.3,00,000/- to the accused and
therefore there is no receipt available with me about that amount. It
is not true to say that there is no documentary evidence with me
about payment of Rs.3,00,000/- to the accused. It is not true to say
that the subject cheque was given by the accused to my husband in
the year 2014 when the accused borrowed Rs.1,50,000/- from my
husband. I don’t know what document I have about the alleged
transaction.
22. I don’t use to file income tax return. I don’t know I have
any proof about payment of money to the accused. It is true to say
that I have no any other document about the payment of money to
the accused and therefore I have not produced that document till
today. I am unaware that whether or not the accused is able to read
and write. It is true to say that I had been to the house of accused to
ask for repayment of money. It is not true to say that despite

repayment of money by the accused to my husband, my husband did
not return the subject cheque to the accused and told him that the
subject cheque is lost. It is not true to say that I have missused the
cheque given by the accused to my husband.
23. I had never seen the medical document of the accused in
August 2021. It is not true to say that I have filed another complaints
against the accused. I don’t remember the date when I have paid
amount of Rs.3,00,000/- to the accused. I have paid the said amount
in the house of accused.
Due to recess Cross examination is deferred till next date.
