1. Perused record. Heard both the sides.
2. The accused prayed for bail mainly on the ground that he is innocent.
Investigation is over and he is ready to remain abide by the conditions, if any,
imposed. No offence punishable under Section 326 of Indian Penal Code made out.
Investigating Officer and Ld. A.P.P. objected to it stating that allegations are serious.
Grievous hurt is caused with dangerous weapon i.e. iron rod. Investigation is in
progress and there is possibility of tampering.
3. Accused is in custody since long. Investigation over and charge sheet is filed.
From the material produced there appears doubt about the offence alleged i.e. major
offence punishable under Section 326 of Indian Penal Code, whether it is committed
or not? Moreover, offence is triable by this Court itself. Accused is ready to remain
abide by the conditions. The conclusion of investigation, filing of charge-sheet and
consequent conclusion of trial will take much time. Considering all these aspects
and facts and circumstances and reasons assigned in the bail application following
order.
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of Rs.10,000/-.
c. Time of two months granted for furnishing S.B.
d. Accused shall furnish his detail address and proof thereof.
