ORDER PASSED BELOW EXH.1
This application is filed by the applicant namely Naseem
Mohammed Shafique Warsi for release of seized muddemal, which
annexed as ExhA, which is seized by the Nirmal Nagar police station in
connection with Crime No.929/2022 registered with said police station for
the offence punishable under section 454, 457, 380, 341, 504 r/w 34 of
IPC.
2) Say was called from I. O. and A.P.P. I.O. has no objection. Ld.
APP has an objection and submitted that it is essential at the time of trial.
She prayed for rejection.
3) In support of her contention regarding ownership, applicant
has filed on record xerox copies of FIR, statement, invoices & Aadhar card
alongwith her affidavit. She has not stated the particulars of muddemal or
total description in Exhibit 1. She simply stated as the list of items annexed
to ExhA but she has not filed any annexure. Therefore, she is not entitled
to get the custody of the items. Under such circumstances, I pass following
order :
