ORDER BELOW EXH.1
1. The accused through his Special Power of Attorney Holder Mr.
Parth Ashok Chandak, in NCCR Portal Complaint No.31903250048757
registered with West Regional Cyber Police Station, B.K.C., Mumbai, has
filed this application to defreeze savings bank accounts
No.309013308526 RBL Bank, Branch Ankleshwar, Gujrat, IFSC Code
RATN0000227, Bank Account No.309013309330 RBL Bank, Branch
Ankleshwar, Gujrat, IFSC Code RATN0000227 and Bank Account
No.02551460001032 HDFC Bank, Branch Ankleshwar, Gujrat, IFSC
Code HDFC0000255. Perused application, say of I.O., Ld. A.P.P. and
complainant. Heard Ld. Advocate for accused, Ld. Advocate for
complainant and Ld. A.P.P.
2. According to I.O. the complainant failed to appear for inquiry
though repeated requests by mail and phone calls were made by the I.O.
Considering the allegations of complainant and the written submission of
accused the I.O. has opined that there is no cyber fraud as the
complainant is not attending and there is no online fraud. The complaint
on NCCR Portal is closed by the In-charge of Cyber Police Station. Said
fact is communicated to complainant through the portal. Therefore, the
Sr. P.I. of Cyber Police Station, Mumbai has no objection to unfreeze the
said bank accounts. Moreover, according to I.O. there are discrepancies
in the complaint registered at NCCR Portal and the facts narrated by the
complainant. Considering the stand of I.O. and the in-charge of Cyber
Police Station, it appears that said case is closed by the Cyber Police
Station. Therefore, said accounts need not to be keep frozen. Hence,
present application deserves to be allowed. Accordingly, I proceed to
pass the following order -
ORDER
a. The application is allowed in following term -

b. The aforesaid bank accounts shall be unfreeze forthwith.
