ORDER BELOW EXH.1
1. Today, the accused pleaded guilty to the offence. His plea is
voluntary as despite giving clear understanding to him about the effect of
punishment, he has pleaded guilty to the offence. Plea accepted.
2. Heard him on the point of sentence. He prayed for leniency.
Accused is in custody since 30.09.2022. Accused had stolen the
motorbike of value of Rs.40,000/-. The stolen property is already
recovered. Therefore, considering the nature of offence and his prayer,
following order :
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Section 379 of Indian Penal
Code and Section 142 of Maharashtra Police Act, and sentenced to suffer
simple imprisonment for one month for each of the offences. All these
sentences shall run concurrently.
B. He is entitled to set off for the above period from the substantive
jail sentence as per Section 428 of the Code of Criminal Procedure.
Accused shall be released on 29.10.2022, if not required in any other
offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
