ORDER BELOW EXH.1
The applicant on 13/12/2023 has filed the present
application for making death entry of Mrs. Laisa Begum W/o.
Ehasanullah Coudhary, who died on 14/04/2021, against concerned
authority of Municipal Corporation of Greater Bombay. However, as
per the amended provision dated 11/08/2023 in the Registration of
Birth and Death Act, 1969, any birth or death of which delayed
information is given to Registrar after one year of its occurrence, shall
be registered only on an order made by a District Magistrate or Sub-
Divisional Magistrate or by an Executive Magistrate authorized by the
District Magistrate, having jurisdiction over the area where the birth
or death has taken place, after verifying the correctness of the birth
or death and on payment of such fees as may be prescribed.
2. Therefore, in view of the amendment in the Act the
application needs to be filed before competent authority, as
contemplated in the amended provision of the Act. Hence,
application be returned to the applicant to file it before appropriate
forum, which having jurisdiction to decide the application.
