ORDER BELOW EXH.1
1. On 01.01.2024, the accused appeared before jail court at M.C.P. Arthur
Road, Mumbai. The accused pleaded guilty to the offence.
2. He is totally made aware of the consequences of the pleading guilty to
the offence. Despite that he is ready to plead guilty. His plea is voluntary.
3. Heard him on the point of sentence. He prayed for leniency. Accused is
in custody since 22.09.2023. Accused had stolen the Activa motorcycle,
bearing registration No.MH-01-CE-0284, of value of Rs.15,000/- and he is in
jail for more than three months. Therefore, considering the nature of offence
and his prayer, following order :
ORDER
A. The accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Section 379 of Indian Penal Code
and sentenced to suffer simple imprisonment for three months for offence
punishable under Section 379 of Indian Penal Code.
B. Accused is entitled to set off as per Section 428 of the Code of Criminal
Procedure. As he is in jail since 22.09.2023, the punishment has already been
undergone by him, therefore, he shall be released forthwith if not required in
any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
