ORDER BELOW EXH.1
1. Today the Accused No.1, Abdul Rafique Abdul Rehman Sayyad @
Avva, appeared before this court through video conferencing. The
accused pleaded guilty to the offence. His plea is voluntary as despite
giving clear understanding to him about the effect of punishment, he has
pleaded guilty to the offence. Plea accepted.
2. The accused has stolen chairs, of value of Rs.3,000/-. Heard him on
the point of sentence. He is in jail since 27.08.2022. He prayed for
leniency. Considering the nature of offence, the property involved and the
period undergone by the accused, following order :
ORDER
A. Accused No.1, Abdul Rafique Abdul Rehman Sayyad @ Avva, is
convicted under Section 241 of the Code of Criminal Procedure, for an
offence punishable under Sections 394, 427, 452, 504, 506(II) r/w.34 of
IPC and Section 37(1)(A) r/w. 135, 142 of Maharashtra Police Act.
B. Accused No.1, sentenced to suffer rigorous imprisonment for three
months for the offence punishable under Section 394 of Indian Penal
Code and simple imprisonment of one month for each of the offence
punishable under Sections 427, 452, 504, 506(II) of Indian Penal Code
and Sections 37(1)(A) r/w. 135, 142 of Maharashtra Police Act, 2016.
C. All these sentences shall run concurrently.
D. He is entitled to set off for the above period from the substantive
jail sentence as per section 428 of the Code of Criminal Procedure. As he
is in jail since 27.08.2022, therefore, he shall be released on 26.11.2022,
if not required in any other offence.
E. The property seized shall be handed over to informant.

F. The Accused No.2. Masiulla Sobatali Salmani @ Neta, is on bail.
Proceeding is ordered to be continued against him.
