ORDER BELOW BAIL APPLICATION NO. 4052 of 2022
1. Perused record. Perused say filed by Ld. A.P.P. Heard both the
sides.
2. It is submitted that Accused No.2, Masiullah Sobatali Salmani @
Neta, is innocent and investigation relating to him is over. He is falsely
implicated in this case. He is ready to co-operate with the investigation
and conditions, if any, imposed, etc. Ld. A.P.P. objected to it mainly on
the grounds that offence is serious and non-bailable. Therefore,
application shall be rejected.
3. Accused is in custody since 24.08.2022. Investigation relating to
accused is over and charge-sheet is also filed. Offence is triable by this
Court itself. Allegations are not much serious, though offence constituted
is punishable under Section 394 of Indian Penal Code. Accused is ready
to remain abide by the conditions. Considering all these aspects and facts
and circumstances and reasons assigned in the bail application following
order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.15,000/-. Permission granted to deposit cash security instead of surety
bond.
c. Accused shall furnish his detail address and proofs thereof.
