Perused the chargesheet. It appears that offence
punishable under section 338 of IPC is punishable upto 2 years. In this
chargesheet, the incident caused on 11.10.2019 and the chargesheet is
filed on 16.09.2022. As per section 468 (3) of Cr.P.C., the limitation for
filing chargesheet is three years. It means that it is filed within
limitation and therefore it is accepted. Said case is reregistered as
summons case.
