ORDER BELOW EXHIBIT - 01
1. Today the matter is taken before this Court in Special Drive for
disposal of petty cases. Perused record. The present prosecution is lodged
in respect of an offence punishable under section 12 (a) of Maharashtra
Prevention of Gambling Act.
2. The matter is old. The allegations are vague. No offence is made out
even if those allegations accepted as they are, therefore, following order :
ORDER
A. The proceeding stopped under section 258 of Code of Criminal
Procedure.
B. The accused are discharged.
C. The articles seized shall be disposed off and cash seized shall
be forfeited to the Government.
D. Cash surety, if any, deposited shall be refund to the accused, if
claimed within one year from today.
E. After one year the cash surety amount be forfeited to the Government.
Liberty granted to the accused to claim it even after one year also, if
any special reason shown to the Court.
