Order Below Bail Application
Perused bail application and say of I.O. and Ld. A.P.P. Heard both
side. Accused Ashish Ashok Khanna is charged for the offence
punishable U/Secs.318(4), 319(2), 336(2), 336(3), 338, 340(2), 61 of
the BNS and Sections 66-C and 66-D of Information Technology Act.
Prosecution alleged that, present accused has induced the informant to
invest Rs.5,24,00,000/- in the fake Tars company and all accused
misappropriated said amount of informant. Present accused is allegedly
involved in this crime only to cheat informant. The informant has filed
affidavit stating that present accused has given D.D. of Rs.20 lakhs to
him towards the loss incurred to him and therefore, the informant has
no objection to grant bail to present accused. Offence is triable by this
court. No purpose would be serve by keeping the accused behind the
bar. There is no criminal antecedents of the accused. Therefore, the
accused is entitle to enlarge on bail. Accordingly, I proceed to pass the
following order -
ORDER
1. Accused is released on furnishing P. B. of Rs.25,000/- and on
deposit of cash bail of Rs.1,00,000/- (Rupees One Lakh only).
2. Accused to submit his address proof.
3. Accused shall not tamper the evidence and shall not pressurize
the prosecution witnesses.
4. Accused shall not leave India without prior permission of the

Court till conclusion of the trial.
5. Accused is directed to remain present each and every date and
in default his bail bonds would automatically forfeit.
6. Accused is directed to attend the Cyber Police Station West
Division on every Wednesday in between 10.00 am to 12.00
noon till the filing of charge-sheet or until further order,
whichever is earlier.
7. Accused shall not misuse the liberty.
8. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
