1. This is an application filed by the applicant Mohammed
Shafique Amir Ali Shaikh seeking release of the property i.e. Scooty
Suzuki Access 125 bearing registration No.MH-01-DV-7033, Chasis No.
MB8DP12DVM8574762 Engine No.AF212496262, worth Rs.65,000/-
seized in C.R.No. 426/2025 of Police Station, Mahim.
2. Perused the contents and the say of I.O. and Ld. APP. On
going through the say of Investigation Officer it reveals that the
Investigating Officer has submitted no objection for return of the vehicle
on terms and conditions. Ld.A.P.P. submitted that the said vehicle belongs
to applicant, hence it may be returned to the applicant on terms and
conditions. In this regard the owner of the vehicle as per the R.C.Book is
Mohammed Shafique Amir Ali Shaikh i.e. applicant. The FIR shows that
the said vehicle is stolen from the custody of the Mohammed Shafique
Amir Ali Shaikh i.e. the applicant. Hence, it seems that, the applicant is
lawful possessor of said vehicle claimed. Considering the nature of the
offences there is no need to detain the said vehicle. On the contrary, its
detention results into damage of the vehicle. Hence, order.
O R D E R
1. Application is allowed.
2. Police Station, Mahim is hereby directed to released Scooty
Suzuki Access 125 bearing registration No.MH-01-DV-7033, Chasis
No. MB8DP12DVM8574762 Engine No.AF212496262, worth
Rs.65,000/- seized in C.R.No. 426/2025 of Police Station, Mahim

to the applicant Mohammed Shafique Amir Ali Shaikh, on his
executing Indemnity Bond of Rs.70,000/-(Rupees Seventy
Thousand only) on Rs.200/- Stamp Paper.
3. Applicant shall not sell or alienate it till further direction of the
Court.
4. Applicant shall file photographs of the said vehicle on record.
5. The applicant is directed to produce the said vehicle as and
when required by the Court.
Issue Humdast accordingly.
