ORDER BELOW EXH.1
1. Today, the accused persons Mr. Saheb Tamulhaq Shaikh and Mr.
Suraj Sajahan Shaikh, appeared before jail court. They pleaded guilty to
the offence. Their plea is voluntary as despite giving clear understanding
to them about the effect of punishment, they have pleaded guilty to the
offence. Plea accepted.
2. Heard them on the point of sentence. They prayed for leniency.
Accused are in custody since 07.08.2022. Accused had attempted theft of
some building steel and they are in jail for more than two months. The
period undergone is disproportionate to the possible punishment.
Therefore, considering the nature of offence and their prayer, following
order :
ORDER
A. Accused are convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Section 379 r/w.511 and 34 of
Indian Penal Code and sentenced to suffer simple imprisonment for one
month each.
B. They are entitled to set off as per Section 428 of the Code of
Criminal Procedure. As they are in jail since 07.08.2022, the punishment
has already been undergone by them, therefore, they shall be released
forthwith if not required in any other offence.
C. Copy of this order to be given free of cost to the accused.
