Today matter is taken up before this court in Special Drive for petty
cases. Present matter is old. It is filed for an offence punishable under
Sections 4 of the Cigarettes and Other Tobacco Products (Prohibition of
Advertisement and Regulation of Trade and Commerce, Production,
Supply and Distribution) Act, 2003 and Section 2 of the Prohibition of
Smoking in Public Place Rules, 2008. The maximum punishment
provided for these offences is fine and imprisonment upto six months.
2. As per Section 468(2)(a) of Code of Criminal Procedure, the
maximum time provided to take cognizance for the offences with which
the accused charge sheeted is six months. The record shows that the
present final report filed after elapsing said period of limitation. Thus,
cognizance is barred by limitation and hence, following order :
ORDER
Final report is rejected.
